5. Transportation Services
Blacklivery Freight LLC is a for-hire motor carrier of property (except household goods) operating under USDOT #4464885 and FMCSA operating authority MC #1761318. Shipments accepted by Blacklivery are transported by Blacklivery using its own drivers or owner-operators operating under Blacklivery's authority.
Blacklivery Freight does not currently hold property broker or freight forwarder authority and does not arrange transportation by other motor carriers for compensation. Brokerage and freight forwarding services are not offered until the applicable FMCSA authority has been granted.
Where a shipment involves international, ocean or air transportation or customs clearance, those services are performed by independent, appropriately licensed third parties (such as licensed customs brokers and freight forwarders) contracted directly with or on behalf of the shipper, where legally permissible. Blacklivery is responsible only for the domestic motor carrier transportation it performs.
Interstate shipments transported by Blacklivery are subject to the Carmack Amendment (49 U.S.C. § 14706), unless otherwise agreed in writing.
6. Payments & Billing
All payments are processed securely through Stripe. By using our payment features, you also agree to Stripe's Terms of Service.
- Shippers: Quotes are valid for the period stated. Accepted quotes become binding. Payment is due upon invoice generation unless credit terms are arranged.
- Carriers: Settlement amounts are based on the agreed carrier rate for each load. Settlements are processed according to the schedule displayed on your dashboard. Subscription fees for premium portal access are billed according to the selected plan.
- All amounts are in USD unless otherwise stated.
- Late payments may incur additional fees as specified in individual service agreements.
7. Subscription Plans
Certain carrier portal features require a paid subscription. Subscription details, pricing, and included features are displayed at the time of purchase. Subscriptions auto-renew unless cancelled before the renewal date. Refund policies for subscriptions are determined on a case-by-case basis.
8. Compliance & Regulatory
All users operating in the transportation industry must comply with applicable federal, state, and local regulations, including but not limited to FMCSA safety regulations, DOT requirements, Hours of Service rules, drug and alcohol testing requirements, and hazardous materials regulations where applicable.
Blacklivery monitors carrier compliance through our platform. Carriers with expired insurance, lapsed operating authority, or other compliance deficiencies may have their accounts restricted until resolved.
9. Document Uploads & Digital Records
Users may upload documents including insurance certificates, BOLs, PODs, W-9 forms, and other operational documents. You represent that all uploaded documents are authentic, current, and accurate. Falsifying documents is grounds for immediate account termination and may be reported to relevant authorities.
